Acceptance / 接受條款

By registering or using REAL, operated by 艾米亞創意行銷企業社, you agree to these Terms of Service and the Privacy Policy (including processor/DPA terms). If you use the Service on behalf of an organization, you represent that you have authority to bind that entity.

使用 REAL 即表示您同意本條款與隱私權政策。若您不同意，請勿註冊或使用本服務。

Service description / 服務說明

REAL is a SaaS social automation platform for Facebook, Instagram, Threads, and YouTube (public comment auto-replies, keyword DMs, flows, inbox, contacts, broadcasts, analytics). YouTube supports public comment replies only (no YouTube DMs). The Service depends on third-party APIs; platform changes may affect availability and do not alone constitute our breach. Beta/preview features may be unstable and change without GA-level commitments.

功能包含公開留言自動回覆、私訊關鍵字回覆、多步驟流程、訊息中心、客戶名單、廣播與數據分析。YouTube 僅支援公開留言回覆。實際功能與方案以平台公告為準。

Account, acceptable use & platform rules / 帳戶與使用規範

Keep credentials secure; comply with Meta, Threads, Google/YouTube policies. You are responsible for automation content, recipients, and lawful End-User notices. Do not place URLs in Facebook/Instagram public comment replies. Do not spam, abuse the Service, resell seats, or circumvent quotas/security. We may suspend or terminate for violations without refund except where mandatory law requires otherwise, and may retain audit logs under our Platform Abuse Handling SOP.

• 禁止違法、詐欺、騷擾、濫發訊息或侵害他人權利
• 禁止於 FB／IG 公開留言回覆放置任何網址（連結僅得於私訊提供）
• 禁止轉售方案名額或以自動化規避配額與安全機制
• 就終端使用者資料，您為蒐集者／控管者，我們原則為受託處理者

Billing, auto-renewal & consumer rights / 訂閱與退款

Trials and paid plans (flat recurring fees by connected-account quotas; not billed by follower/contact count) are as shown on pricing/checkout. Subscriptions auto-renew unless cancelled before renewal. Non-payment may lead to suspension. Payments via Stripe (or similar). Taxes may apply. Consumer cooling-off under Taiwan Consumer Protection Act applies where mandatory; business customers’ paid fees are generally non-refundable except mandatory law, written agreement, or material defect attributable to us.

Confidentiality, IP, disclaimer, liability & indemnity

Each party must protect the other’s Confidential Information for three (3) years after termination (trade secrets longer as required). The Service is provided “as is.” To the extent permitted by law, total liability is capped at fees actually paid in the twelve (12) months before the claim (zero during free trial); indirect/lost-profits damages are excluded where permitted. You indemnify us for claims from your content, settings, or violations; we provide a limited IP indemnity to business customers as described in the full Terms.

本服務依現狀提供；法律允許範圍內總責任以上開十二個月實付費用為上限。您應賠償因您的內容／違規所致之請求；企業客戶就服務軟體本身之台灣智財侵權，得依完整條款主張有限補償。

Availability, export, governing law

No uptime SLA unless separately agreed in writing. Export/sanctions laws apply. These Terms are governed by Taiwan (R.O.C.) law; negotiate first, then Taipei District Court has first-instance jurisdiction unless mandatory consumer rules provide otherwise.

除另有書面 SLA 外不保證特定可用性。本條款以中華民國法律為準據法；爭議先協商，不成時以臺灣臺北地方法院為第一審管轄法院（消費者強制規定除外）。
